Tree Surgeons Balham Terms and Conditions
These Terms and Conditions set out the basis on which tree surgery services are provided by Tree Surgeons Balham to residential, commercial, and other clients. By making a booking, accepting a quotation, or allowing work to begin, the client agrees to be bound by these terms. They are intended to create a clear understanding of the scope of service, the booking process, payment obligations, cancellations, liability limits, waste handling requirements, and the legal framework that applies to the contract. For the purposes of this document, references to tree surgeons Balham, Balham tree surgery services, or tree surgery services in Balham mean the same service provider and should be read accordingly.
All services are supplied subject to a written or verbal quotation and any specific notes issued before the work starts. Where there is any inconsistency between a quotation and these terms, the quotation will apply only to the extent that it expressly changes these terms. The client is responsible for ensuring that they have read and understood the terms before confirming the booking. In particular, the client should note that tree surgery work can involve access limitations, weather dependence, third-party permissions, and waste disposal requirements that may affect the final delivery of the service.
These terms are designed to support a professional and transparent working relationship. They do not replace statutory rights that cannot be excluded under UK law. Nothing in this document limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other matter that cannot lawfully be limited. All other provisions are intended to operate within the bounds of applicable legislation and industry practice.
1. Booking Process
A booking is usually made after an initial enquiry and a review of the required work. The client may be asked to provide photographs, tree locations, access details, and a description of the desired outcome. In some cases, a site visit may be necessary before a quotation can be issued. A quote from Balham tree surgeons is generally based on the information made available at the time and may change if the facts provided are incomplete or materially inaccurate.
A booking is only confirmed once the quotation is accepted and the client receives confirmation from the service provider. The confirmation may include the estimated date of work, the scope of services, any prerequisites, and any terms specific to the job. The client must ensure that the person confirming the booking has authority to do so. If the booking is made by a landlord, managing agent, tenant, or contractor, the person making the booking warrants that they are authorised to instruct the works.
Before work begins, the client must disclose any known hazards or restrictions, including underground services, structural concerns, protected habitats, nesting birds, tree preservation orders, conservation area status, shared boundaries, or risks associated with nearby structures. Tree surgeons in Balham may refuse, suspend, or amend work if conditions are unsafe, unlawful, or materially different from what was disclosed at booking. Any additional charges caused by undisclosed issues may be added to the invoice where reasonably necessary.
2. Pricing and Payments
Unless stated otherwise, quotations are valid for a limited period and may be withdrawn or revised if circumstances change. Prices may be quoted as fixed fees or as estimated charges. An estimate is not a guarantee of final price. If the work takes longer, requires additional machinery, involves extra labour, or generates more waste than anticipated, the final amount may differ from the original estimate, provided the change is reasonable and linked to the actual work carried out.
Payment terms will be stated on the quotation or invoice. In many cases, payment is due on completion of the works, although deposits or staged payments may be required for larger or specialist jobs. The client agrees to make payment in full by the due date and without set-off, deduction, or counterclaim unless required by law. Late payment may result in interest, recovery costs, and the suspension of further services. Any bank charges arising from failed payments are the responsibility of the client.
If a quotation is given on the basis of tree surgery being completed during normal working conditions but the site proves to be more complex, the provider may adjust the price to reflect the additional time, equipment, or manpower required. This may apply where access is restricted, waste has to be carried a significant distance, or the work must be carried out in stages. The client will normally be informed of such changes as soon as practicable.
3. Cancellations, Delays, and Rescheduling
The client may cancel or rearrange a booking by giving reasonable notice. If notice is given at short notice, a cancellation charge may apply to cover administrative time, labour allocation, and any costs already incurred. Where materials, specialist equipment, or subcontractors have been arranged specifically for the job, these costs may also be charged to the client if they cannot be recovered. The amount charged will be fair and proportionate to the loss suffered.
The service provider may cancel or reschedule a booking due to adverse weather, unsafe working conditions, equipment failure, illness, access problems, legal restrictions, or other events beyond reasonable control. Tree surgery work is highly dependent on safe conditions, and the provider may decide that it is not appropriate to continue even after work has started. In such circumstances, the provider will aim to agree a new date and to minimise inconvenience. No liability will arise for delay caused by factors outside the provider’s reasonable control.
Where the client is not available at the agreed time, or where access has not been properly arranged, the provider may charge for wasted attendance or return visits. Any required permits, parking arrangements, traffic management, neighbour notifications, or access permissions should be arranged in advance by the client unless the quotation states otherwise. Failure to do so may result in delay, extra costs, or cancellation of the job.
4. Scope of Work and Client Responsibilities
The service is limited to the work described in the quotation or booking confirmation. Any additional task requested on site may be accepted or declined at the provider’s discretion and may require a revised price. The client should not assume that ancillary services such as stump grinding, hedge reduction, pruning beyond the agreed area, or removal of extensive arisings are included unless expressly stated.
The client must ensure that the area where the work is to be carried out is reasonably accessible and safe for the team, machinery, and vehicles. Items that could be damaged should be removed or protected before work begins. This includes garden furniture, ornaments, lighting, vehicles, and fragile surfaces. The provider will take reasonable care, but the client remains responsible for preparing the site and for identifying any hidden risks that are known to them.
Where the work requires consent from a landlord, freeholder, neighbour, or local authority, the client must obtain that consent unless the service provider has expressly agreed to do so. Tree surgery Balham services do not include legal advice, and the client remains responsible for compliance with any permits, planning rules, conservation controls, or contractual obligations affecting the property.
5. Liability and Risk
Tree surgery involves inherent risks, including falling branches, movement of timber, stump activity, flying debris, and changes in tree stability. The provider will use reasonable skill and care and will aim to reduce foreseeable risks through appropriate methods, training, and equipment. However, the client acknowledges that trees can behave unpredictably and that certain outcomes, including minor surface damage, scarring, or changes in appearance, may occur despite careful work.
Subject to the paragraph above, the provider will not be liable for indirect or consequential loss, loss of profit, loss of business, loss of opportunity, or loss arising from delay, except where such exclusion is unlawful. Any liability for direct loss shall, where permitted by law, be limited to the amount paid or payable for the particular service giving rise to the claim. The client is expected to maintain appropriate insurance for their property where necessary.
The provider is not responsible for pre-existing defects, hidden decay, root damage, unstable structures, or failure of trees or branches that were already compromised before the work began, unless such damage is caused by negligence. The client must notify the provider of any known defects or previous incidents. If the provider identifies a material safety concern, work may be paused or altered to avoid unnecessary risk. In some cases, an independent arboricultural opinion may be recommended before continuing.
6. Waste, Disposal, and Environmental Compliance
All green waste, timber, and related arisings generated by the work will be handled in accordance with applicable waste regulations and environmental requirements. Unless the quotation states that the client will retain the waste, the provider will generally remove it from site for lawful disposal, recycling, or recovery. The client acknowledges that waste produced during tree surgery may be subject to controlled handling, transportation, and transfer rules.
Where waste is removed by the provider, it will be taken to an authorised facility or handled through an approved disposal route. The provider may segregate timber, brash, wood chip, and other materials for recycling where reasonably practicable. Any waste that is specifically retained by the client becomes the client’s responsibility from the moment it is left on site, and the client must manage it lawfully. The client must not request illegal tipping, burning, or dumping of waste.
If waste is left on site by agreement, the client is responsible for storing and disposing of it in compliance with local and national environmental laws. The provider may charge additional fees if waste volumes exceed the original assessment or if disposal requires extra visits. Any contaminated, invasive, or restricted waste must be disclosed in advance so that appropriate handling arrangements can be made.
7. Complaints, Variations, and Termination
If the client believes that the service has not been performed in accordance with the quotation, they should raise the issue promptly and provide reasonable details of the concern. The provider may inspect the work, carry out remedial steps where appropriate, or explain why the work was completed in line with the agreed specification. Complaints will be handled in a fair and practical manner, but the provider is not obliged to remedy matters that arise from incorrect instructions, undisclosed conditions, or normal characteristics of tree work.
Any variation to the agreed service should be confirmed in writing where possible. Verbal changes made during the course of the work may still be chargeable if they are clearly requested by the client and acted upon by the provider. The provider may terminate the contract immediately if the client behaves abusively, prevents safe working, fails to make payment, or otherwise breaches these terms in a serious way. In such cases, the client may remain liable for work already completed and costs already incurred.
These terms may be updated from time to time, but changes will not affect bookings already confirmed unless the client agrees or the change is required by law. The version of the terms that applies to a booking is the version in force at the time that booking is confirmed, unless otherwise stated.
8. Governing Law
These Terms and Conditions, and any dispute or claim arising from them or in connection with them, shall be governed by and interpreted in accordance with the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction, except where the client is entitled to bring proceedings in another jurisdiction under mandatory consumer law or other applicable rules that cannot be excluded.
Any dispute should first be raised informally so that the parties can attempt to resolve the matter without legal action. If a dispute cannot be resolved amicably, either party may pursue the matter through the appropriate legal channels. The parties agree to act reasonably and in good faith when seeking a solution, especially where the issue concerns performance, payment, or alleged damage arising from tree surgery works.
This document represents the general terms of service for tree surgeons Balham projects and should be read together with any quotation, invoice, or written confirmation issued for the specific job. If any part of these terms is found to be unenforceable, the remaining provisions will continue in full force to the extent permitted by law. By proceeding with a booking, the client confirms that they accept these conditions for the provision of arboricultural services.
